WEIPA CAMPING GROUND

Rules, Terms & Booking Conditions

Access to and use of this website is, and the products and services available through this website are, subject to these terms and conditions (“Terms”). By using this website and/or booking with Us, You are agreeing to all of the terms and conditions, as updated from time to time. You should check this page regularly to take notice of any changes We may have made to Our terms and conditions.

1. Amendments to Terms

We reserve the right to amend these Terms from time to time. Amendments will be effective immediately upon notification on this website. Your continued use of this website will represent an agreement by You to be bound by the Terms, as amended.

2. Travel Insurance

We strongly recommend You take out comprehensive travel insurance prior to the date of travel for Your Booking. This insurance should cover cancellation, in so far as such cancellation is non-refundable under the Cancellation Policy.

3. Bookings

In order to secure a Booking, You must:

specify the time, date(s) and duration of Your preferred stay;
specify the preferred accommodation and/or camping option for Your Booking;
state the exact number and age of persons that will be attending the Site under the Booking; and
pay the Deposit.

Booking options, dates and times are subject to availability and are not secured until We have provided written confirmation to You.

4. Fee

By making a Booking, You accept these Terms and the Fee for the Booking.
The Fee for a Booking is determined as follows:

for two (2) persons or less, the Base Rate; or
for more than two (2) persons, the Base Rate plus any applicable additional charges under the following clause.

For a Booking for more than two (2) persons, the Fee is determined as the Base Rate, plus:

for a Room, $20 per person, per night of the Booking; and/or
for a Camp Site: $10 per person over the age of 15 years, per night; and $5 per person between the ages of 5 to 15 years, per night.

The Fee is subject to change, and We reserve the right to vary the Fee at any time prior to Your Booking by written notice to You.

5. Payment

All payments to Us are to be made by a single credit/debit card as and when required under these Terms and, by providing Us with Your credit/debit card details, You authorise Us to deduct any such payments when they are due.
You must pay a Deposit to secure a Booking, which will be credited towards the Fee payable by You for the Booking.
The balance of the Fee for the Booking must be paid on the morning of Your Booking. We will deduct the balance of the Fee from Your nominated credit/debit card on the morning of Your Booking.
You acknowledge and accept that a card payment fee of 1% applies to all transactions and that, by providing Us with Your credit/debit card details, You authorise Us to deduct the card payment fee in addition to the Fee payable by You.
It is Your responsibility to ensure there are sufficient funds in Your credit/debit card available for payment of the balance of the Fee on the morning of Your Booking. Should Your credit/debit card default, We will notify You immediately and require You to pay the balance of the Fee. Should You fail to make payment of the balance of the Fee, We reserve the right to cancel Your Booking and retain the Deposit.

6. Variation

You may request for a variation to Your Booking by providing a request in writing to Us at reception@campweipa.com.au no later than 72 hours before Your scheduled arrival time.
A request for variation of a Booking is subject to availability, must be agreed by Us in writing to have effect and We are under no obligation to accept a request for variation.
Any variation to a Booking may incur additional costs and vary the Fee in accordance with these Terms.

7. Cancellation Policy

All cancellations to booking must be advised in writing 72 hours prior to arrival to reception@campweipa.com.au
Deposit taken at time of booking is refundable up until 72 hours prior to arrival, after which time is non-refundable.
Any changes to your booking (including early check out) must be advised of at least 72 hours before check in.
If you fail to arrive for your reservation, the full amount of the reservation is forfeited. No refunds are available for early departures.

WE RECOMMEND OBTAINING TRAVEL INSURANCE BEFORE DEPARTING ON YOUR TRAVELS.

We reserve the right to cancel Your Booking at any time at Our Discretion with written notice to you. Should we cancel Your Booking under this clause, we will provide you with a full refund of the deposit less the transaction fee.

8. Booking Credit

As an alternative to cancellation pursuant to the first clause in our Cancellation Policy above, upon Your request We may, at Our absolute discretion, grant You with credit equal to the amount of the Deposit paid (Credit).
You may only use the Credit, in part or in full, towards payment of any purchases or future bookings with Us for a period of 12 months from the date of issue. If You do not use all the Credit within the 12 month period, the Credit, or any part thereof, will be forfeited.
The Credit is not redeemable for cash, meals, sightseeing services or transferrable to any other person.

9. Check-in and Check-out

Check-in times are as follows:
- Room – 2pm on the first day of Your Booking;
- Camp Site – 12pm on the first day of Your Booking; or
- At a time as pre-approved in writing by Us.
Subject to clause below, You must check-out by no later than 10am on the last day of Your Booking.
Subject to written pre-approval from Us and payment of an additional $30, You may check out by 12pm on the last day of Your Booking.
If You do not check-out pursuant to the two above clauses as applicable, We reserve the right to charge You for additional day(s) at the applicable Fee until You depart.
In addition to the above clause , if you do not check out and the space/room you are occupying is pre-booked for another guest We reserve the right to charge you a fee for the inconvenience caused.

10. Pet Policy

You acknowledge and accept that no pets are allowed inside Rooms, amenities, pool area, playground, camp kitchen or Barramunchies café.
You acknowledge that You will be required to read and accept Our Pet Policy, provided to You upon arrival.

11. Excessive Noise Policy

You acknowledge and agree that all loud noise, including generators, vehicles, fridges, music and chatter must cease by 10pm.
You agree and You and Your guests must not make excessive noise or cause any nuisance on the Weipa Camping Ground during Your Booking.

12. Rules

You and Your guests must obey all rules of Weipa Camping Ground at all times, including any guidelines, signage, speed restrictions, safety procedures or other reasonable requests by Us.

13. Revocation of Entry

We may elect to revoke Your right to occupy any part of Weipa Camping Ground with immediate effect if You breach any of the Terms or We determine that You or any of Your guests pose a risk or threat to health and safety of other patrons and staff.
You and Your guests must leave Weipa Camping Ground if directed to do so by Us.
You acknowledge that there will be no refund of the Fee, or part thereof, if You or any of Your guests are required to leave Weipa Camping Ground under this clause.

14. Notices

For all notices sent by email, it is deemed to be received by the receiving party when the sending party indicated the email has been successfully sent, unless:

The receiving party, within a reasonable time (and in any event, within 2 business days), informs the sending party of an incomplete transmission; or
The transmission is completed outside business hours in which case the notice is regarded as received at the commencement of business on the following business day.

15. Disclaimer and Limitation of Liability

Subject to any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law, the material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy.
You expressly agree that You use any services provided by Us and stay at Weipa Camping Ground at Your risk. We provide no warranty in relation to, and You agree to release Us from liability for any claim in relation to, the services or goods provided or supplied and under no circumstances are We liable or responsible to You for any loss, damage, costs, expense or other claims as a result, direct or indirect of any defect, deficiency or discrepancy in any goods or services provided.
This is not intended to affect Our liability arising from Our negligence or misrepresentation as to a fundamental matter to the extent that such liability cannot be excluded or limited under applicable law.
You agree to indemnify Us, including Our directors, agents and employees, from and against any claim, action, damage, liabilities, obligations, costs or expense whatsoever arising out of, or resulting from, You and Your guests stay at Weipa Camping Ground including use of Our services.
We have no liability to the extent that the supply of any goods or services is prevented or delayed by force majeure. For these purposes, ‘force majeure’ means any occurrence or omission as a direct or indirect result of which We are prevented from or delayed in performing any of Our obligations, is beyond Our reasonable control and which could not have been prevented or mitigated by reasonable diligence or precautionary measures, including an act or force of nature, natural disaster, acts of terrorism, riots, revolutions, civil commotion, epidemic, pandemic, industrial action, interruption to services, contamination and action or inaction by government agencies.

16. General

Access to this website is permitted on a temporary basis, We reserve the right to withdraw or amend the services without notice. We will not be liable if for any reason this website is unavailable at any time for any period.
Your use of this website, Bookings, the Terms and any dispute arising out of same is governed by and subject to the laws of Queensland, Australia and You submit to the exclusive jurisdiction of the courts of Queensland.
If any part of the terms and conditions is unenforceable (including any provision in which We exclude Our liability to You) the enforceability of any other part of the terms and conditions will not be affected and all other clauses remain in full force and effect. As far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause must be interpreted accordingly. Alternatively, You agree that the clause must be rectified and interpreted in such a way that closely resembles the original meaning of the clause/sub-clause as is permitted by law.

17. Covid-19 Policy

You agree that, if You or any guest have tested positive to Covid-19 or are a close contact of someone that has tested positive to Covid-19, prior to Your scheduled arrival, You or that guest must not attend the Weipa Camping Ground.
In the event You or any guest test positive to Covid-19 whilst at Weipa Camping Ground, You must notify Us immediately. In the event We are unable to accommodate Your or Your guest’s isolation, You or Your guest will be required to leave the Weipa Camping Ground.

18. Definitions

In these terms and conditions, words have the following meaning:

Base Rate means the minimum rate payable for a Booking, accommodating stay for two (2) persons, as advised by Us at the time of Your Booking or otherwise specified on Our website;
Booking means Your booking for accommodation at Weipa Camping Ground;
Camp Site means a powered or unpowered camp site with access to camp kitchen, amenities, laundry and pool;
Deposit means the portion of the Fee payable for two (2) nights’ accommodation (or one (1) night if that is the maximum duration of Booking), as advised by Us;
Fee means the fee for your Booking as advised by Us, calculated in accordance with clause 4;
Room means a lodge, villa, cabin, or donga accommodation at Weipa Camping Ground;
Terms means these terms and conditions;
We, Us or Our means Quartermaine Pty Ltd (as trustee);
Weipa Camping Ground means the amenities, camping ground facilities and all ancillary facilities provided by Us located at Lot 7024, Kerr Point Drive, Nanum QLD 4874; and
You means You, the user of this website and person making a Booking, and Your has a corresponding meaning,
